The Demise of the 28-Clause Peace Proposal for Ukraine: How Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the tension sparked by the presentation of a new 28-article proposal for ending the war appeared – momentarily – to have been stabilised. A American diplomat spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its retaliation: an extensive attack of aerial bombardment on Kyiv.

The Cycle of Peace Talks and Military Action

The sequence of conflicting incidents captured the grim essence of the recent timeframe. By day, diplomatic battles are conducted: hopeful statements are issued from different nations. Significant resources is expended on restraining particular approaches. By night, Russian leadership forcefully demonstrates the world that, for them, war remains the key method for achieving "resolution".

Nocturnal Warfare

As Russia's attack developed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was exposed. Ukraine is able to track projectile deployments from across the border, a capacity enabled by current data. From vantage locations, Ukrainian air force fighter jets that had been scrambled to counter approaching cruise missiles flew past – modern combat jets supplied to Ukraine by NATO members.

Soon thereafter, Kyiv's anti-aircraft weapons activated: defensive missiles deployed against a hostile projectile. This was a modern interception technology at work, most likely provided by partner states. Every launch creates sudden vibrations, causing tremors. The brief panic quickly gives way to sober acceptance: possibly the approaching threat won't cause damage this time, sparing the city from catastrophe and further power outages.

Ongoing Risks

Following this, a automatic firearm opened up on a aerial vehicle somewhere nearby, part of a mobile-fire group – almost certainly imported technology. Unfortunately, the bullets missed the hostile drone – it pressed on overhead toward its objective.

Periodically, this continued until dawn. Kyiv faced the morning news: several casualties, devastation and infrastructure problems in numerous residences as a result of the nocturnal offensive. As typically, everyone still went about their day – enduring hostilities. But those full day illustrated Ukraine's essential dependence on Western support – a need that neighboring countries are evidently unprepared to replace in the immediate future.

Failed Diplomacy

The detailed framework from American leadership sparked intense emotion, discussion and profound anxiety – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and multilateral gatherings.

Every new approach from US leadership adheres to the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They contain the crisis but never actually achieve victory. This pattern will, undoubtedly, endure.

Strategic Calculations

It is convenient to criticize certain parties of repeatedly advocating Kremlin's demands. But that does not seem to be the entire situation. American leadership functions according to a assumption understood by seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The White House presumes that it is impossible to force Russia to surrender the territory that it already controls in Ukraine's occupied territories.

The problem is that while accepting these circumstances, US leadership does nothing to deter Moscow, through statements or actions, from assuming that the situation will not change more in its favour in the near future.

Divergent Views

Therefore, the Kremlin is certain that duration works to their advantage – that Ukraine and its partners are coming close to fatigue. Their motivation to accept conditions that does not give them the maximum possible gain is close to zero. There may be numerous efforts to stop fighting, but they will continue as long as Russia's leader remains supremely confident in the conclusion.

On the contrary, Kyiv believes that Ukraine can still hold out, gradually sacrificing lives and land but avoiding a total frontline collapse until conditions improve in its advantage.

Current Realities

Factually, there are no real preconditions for a truce. Now, individual motivations are becoming relevant: political desires to negotiate peace and achieve global acclaim, and Kyiv's double obstacles – on one hand, not to distance important partners, and on the other, to mobilize citizens around the flag against any proposal Kyiv finds unworkable, so that their focus does not shift toward homefront challenges. And although their mission will now be considerably more difficult after recent developments, it remains highly unlikely that this will change their overall approach.

These two forces are driving the talks.

Assessment and Future

It took a just a single week to kill the proposed articles of the latest plan. Aggressive and erratic handling of the matter by American leadership, resistance by Ukraine and the rest of Europe, along with soothing efforts of negotiators, and finally, current information leaks, all achieved their purpose.

While new initiatives based on old ideas are forthcoming, Kyiv, London and other Western governments should arrive at a critical understanding: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are rooted in Kremlin requirements and reflect certain reluctance to modify developments, if they stand together and improve their protective measures at a much faster pace. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the foreseeable future, primarily depend on ongoing international assistance.
